US Politics: illegal aliens’ rights in US
Self-tutoring about deportations from the US: the tutor mentions a constitutional point.
Lately, one might hear an argument in US politics that goes something like this: Illegal aliens can be deported because, being in the US illegally, they don’t have legal protection from deportation.
Yet, the US constitution seems not to distinguish between legal or illegal aliens, or even citizens, in this regard; rather, it seems to state, in the 5th Amendment, that no person shall “be deprived of life, liberty, or property, without due process of law….”
A weakness in the foregoing statement might be the definition of “due process of law.” However, since the US uses Common Law, one imagines the definition of “due process of law” to be well established.
